Immigrating to the United States

United States Visas

If you are a business person or manager looking to immigrate to the United States there are many options for you. Investors Visas typically fall in the "E" visa category The E1, E2 visas are non-immigrant visas, available to countries from nations which have bilateral investment, commerce, and navigation treaties with the United States. Individuals who qualify will have made a substantial investment in a United States company, and wish to come to the U.S. to develop and direct the business operations of that enterprise. You may check the list of qualifying countries through the USCIS.


**Although an E-2 visa is generally not considered to be a path to permanent residency, in some circumstances, the holder of an E-2 visa may qualify to apply for permanent residency in the United States


The E1 Treaty Trader:

Nationals of qualifying Treaty countries who undertake a significant amount of international trade with the United States may qualify for this type of visa. The volume of such trade must be sufficient to justify the trader or his/her employee(s) being in the United States to manage the trade, and must constitute the majority of the trader's international trade (i.e. at least 50% of the Trader's exports/imports must be to/from the USA). There is no set minimum level of trade which is considered sufficient, but obviously the lower the volume of trade the less likely one is to qualify as a Treaty Trader.


The E2 Treaty Investor:

Nationals of qualifying Treaty countries who have made a significant investment in the United States may qualify for E2 Treaty Investor status. Like the E1 visa, there is no set minimum level of investment which may qualify for E2 status, but the lower the investment the less likely one is to qualify. Again, the level of investment must be sufficient to justify the treaty national (or his/her employees) presence in the United States. The investment must be in an operating business - i.e. simply buying property or stocks and bonds does not qualify. Also, a substantial part of the investment must have been made before applying for E2 status.


Eligibility for the E-2 Visa

Alien investors who meet the following requirements may qualify for an E-2 visa:

  • The investor's home country maintains a treaty of commerce and navigation or bilateral investment with the United States;
  • The investor has made a "substantial investment" (typically $25,000 or more) in a U.S. business;
  • The business in which the investment was made is not less than 50 percent owned by citizens of the treaty country;
  • The investor intends to come to the United States to direct the operations of the enterprise in a capacity that is either executive, supervisory, or involves specialized skills;
  • The investor possesses means of support independent of the enterprise.
  • It may benefit applicants for an E-2 visa to demonstrate that their investments will result in the creation of jobs within the United States.
